    Terms of Service

    1. Agreement to Terms

    These Terms of Service ("Terms") constitute a legally binding agreement between you ("User," "you," or "your") and TrustFinance Ltd. ("TrustFinance," "we," "us," or "our") governing your access to and use of the TrustFinance Awards platform (the "Platform"), including all related services, content, and functionality.

    By creating an account, submitting a nomination, casting a vote, or otherwise accessing the Platform, you agree to be bound by these Terms and our Privacy Policy. If you do not agree, you must not use the Platform.

    2. Definitions

    • "Award Edition" — a specific annual or periodic cycle of the TrustFinance Awards.
    • "Nominee" — a company or entity nominated for consideration in an award category.
    • "Voter" — a registered user who casts votes on the Platform.
    • "Content" — all text, images, data, logos, badges, and materials on the Platform.
    • "Services" — all features, functionalities, and offerings provided through the Platform.

    3. Eligibility

    To use the Platform, you must:

    • Be at least 16 years of age (or the age of majority in your jurisdiction).
    • Have the legal capacity to enter into a binding agreement.
    • Provide accurate and complete registration information.
    • Not have been previously suspended or removed from the Platform.

    4. Account Registration & Security

    You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to:

    • Provide accurate, current, and complete information during registration.
    • Update your information to keep it accurate and current.
    • Immediately notify us of any unauthorized access or use of your account.
    • Not share your account credentials with third parties.
    • Not create multiple accounts for the purpose of manipulating votes or awards.

    We reserve the right to suspend or terminate accounts that violate these Terms or that we reasonably believe are being used fraudulently.

    5. Voting Rules & Integrity

    5.1 General Voting Rules

    • Each registered user may cast one (1) vote per category per voting round.
    • Votes are final and cannot be changed once submitted, unless a correction period is explicitly announced.
    • Daily voting limits may apply as determined by TrustFinance for each Award Edition.
    • All votes are subject to automated and manual fraud review.

    5.2 Prohibited Voting Conduct

    The following activities are strictly prohibited and will result in immediate disqualification:

    • Using bots, scripts, or automated tools to cast votes.
    • Creating multiple accounts to cast additional votes.
    • Vote buying, selling, or trading.
    • Organizing coordinated voting schemes designed to manipulate outcomes.
    • Using VPNs, proxies, or other methods to circumvent geographic or IP-based restrictions.
    • Any other form of vote manipulation or fraud.

    5.3 Fraud Detection & Enforcement

    We employ automated systems including IP analysis, behavioral pattern detection, and rate limiting to identify suspicious voting activity. Flagged votes are subject to manual review. TrustFinance reserves the sole right to:

    • Invalidate and remove fraudulent votes without prior notice.
    • Disqualify nominees who participate in or benefit from vote manipulation.
    • Suspend or permanently ban users engaged in fraudulent activity.
    • Report serious violations to relevant authorities.

    6. Nominations

    • Any registered user may submit a nomination for a company in a relevant category.
    • Nominations are subject to review and approval by TrustFinance at our sole discretion.
    • A nomination does not guarantee inclusion in the award voting process.
    • Nominees must meet category-specific eligibility criteria as published for each Award Edition.
    • TrustFinance reserves the right to reclassify nominees to more appropriate categories.
    • Self-nomination is permitted but does not receive preferential treatment.

    7. Award Results & Methodology

    Award results are determined through a combination of community voting and, where applicable, expert evaluation (Performance Awards). The specific methodology for each Award Edition is published on the Platform prior to the voting period.

    TrustFinance reserves the right to adjust results if vote fraud is detected after results are announced. All decisions by TrustFinance regarding award results are final and binding.

    8. Intellectual Property

    8.1 TrustFinance IP

    All Content on the Platform — including but not limited to text, graphics, logos, award badges, icons, images, software, and the compilation thereof — is the property of TrustFinance or its licensors and is protected by international copyright, trademark, and other intellectual property laws.

    8.2 Award Badge Usage

    • Only verified award winners may use TrustFinance award badges.
    • Badges must be used in accordance with our Brand Guidelines.
    • Unauthorized use, modification, or misrepresentation of badges is strictly prohibited.
    • Badge usage rights are non-transferable and limited to the winning entity.
    • TrustFinance may revoke badge usage rights at any time for violations of these Terms.

    8.3 User Content

    By submitting content to the Platform (e.g., nominations, reviews, comments), you grant TrustFinance a worldwide, non-exclusive, royalty-free, perpetual license to use, reproduce, modify, and display such content in connection with the Platform and our services.

    9. Data Protection & Privacy

    Your use of the Platform is also governed by our Privacy Policy, which details how we collect, use, and protect your personal data in compliance with the EU General Data Protection Regulation (GDPR) and the Thailand Personal Data Protection Act (PDPA).

    By using the Platform, you acknowledge and agree that:

    • We process personal data as described in our Privacy Policy.
    • IP addresses are logged for voting integrity and fraud prevention purposes.
    • You have the rights described in our Privacy Policy (access, rectification, erasure, portability, etc.).
    • You may exercise your data rights by contacting privacy@trustfinance.com.

    10. Prohibited Uses

    You agree not to use the Platform to:

    • Violate any applicable local, national, or international law or regulation.
    • Infringe upon the intellectual property rights of TrustFinance or third parties.
    • Transmit any malware, viruses, or harmful code.
    • Attempt to gain unauthorized access to Platform systems or other users' accounts.
    • Engage in scraping, data mining, or automated data collection without written authorization.
    • Impersonate another person or entity.
    • Interfere with or disrupt the Platform's infrastructure or other users' experience.
    • Post false, misleading, or defamatory content.

    11. Third-Party Links & Services

    The Platform may contain links to third-party websites or services. TrustFinance is not responsible for the content, privacy practices, or availability of such external sites. Your use of third-party services is governed by their respective terms and policies.

    12. Disclaimer of Warranties

    THE PLATFORM IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.

    TrustFinance does not warrant that:

    • The Platform will be uninterrupted, error-free, or completely secure.
    • Award participation will result in any specific business outcomes.
    • All votes will be free from manipulation despite our best efforts.
    • Information on the Platform is always accurate, complete, or current.

    13. Limitation of Liability

    TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, TRUSTFINANCE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO:

    • Loss of profits, revenue, data, or business opportunities.
    • Reputational damage arising from award results or non-selection.
    • Unauthorized access to or alteration of your data.
    • Any conduct or content of any third party on the Platform.

    Our total aggregate liability shall not exceed the amount you have paid to TrustFinance in the twelve (12) months preceding the event giving rise to the claim, or USD $100, whichever is greater.

    14. Indemnification

    You agree to indemnify, defend, and hold harmless TrustFinance, its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorney's fees) arising out of or in any way connected with:

    • Your violation of these Terms.
    • Your use or misuse of the Platform.
    • Your violation of any third-party rights.
    • Any content you submit to the Platform.

    15. Termination

    We may terminate or suspend your account and access to the Platform immediately, without prior notice or liability, for any reason, including if you breach these Terms.

    Upon termination:

    • Your right to use the Platform ceases immediately.
    • We may delete your account data in accordance with our Privacy Policy retention schedules.
    • Provisions that by their nature should survive termination (IP rights, limitation of liability, indemnification) shall continue in effect.

    16. Governing Law & Dispute Resolution

    16.1 Governing Law

    These Terms shall be governed by and construed in accordance with the laws of [Jurisdiction], without regard to its conflict of law provisions. For users in the EU/EEA, mandatory consumer protection laws of your country of residence shall apply where applicable.

    16.2 Dispute Resolution

    Any disputes arising from these Terms shall first be attempted to be resolved through good-faith negotiation. If unresolved within 30 days, disputes shall be submitted to binding arbitration under [Arbitration Rules] in [Jurisdiction], unless prohibited by applicable consumer protection laws.

    16.3 EU Consumer Rights

    If you are a consumer in the EU/EEA, you may also use the European Commission's Online Dispute Resolution platform at ec.europa.eu/consumers/odr.

    17. Modifications to Terms

    TrustFinance reserves the right to modify these Terms at any time. Material changes will be communicated via email or a prominent notice on the Platform at least 14 days before they take effect. Continued use of the Platform after changes constitutes acceptance of the revised Terms.

    If you do not agree to the revised Terms, you must discontinue use of the Platform and close your account.

    18. Severability & Waiver

    If any provision of these Terms is held to be invalid or unenforceable, the remaining provisions shall continue in full force and effect. The failure of TrustFinance to enforce any right or provision shall not constitute a waiver of such right or provision.

    19. Entire Agreement

    These Terms, together with our Privacy Policy and any other legal notices published on the Platform, constitute the entire agreement between you and TrustFinance regarding your use of the Platform, and supersede all prior agreements and understandings.
